The importance of having an Antenuptial Contract (ANC) when getting married in South Africa cannot be overstated. An ANC is a legally binding contract between a couple that sets out their rights and obligations in the event of a marriage breakdown. It is important to have an ANC in place to avoid any potential disputes down the line and to ensure that both parties are on the same page regarding how their assets would be divided if a divorce were to occur.
The South African law states that if couples do not have an ANC in place prior to marriage, then their marriage is automatically subject to the provisions of the law of community of property. The law of community of property says that all property acquired during the marriage is jointly owned by both parties, and that any debts incurred during the marriage are also jointly owned. This means that in the event of a divorce, both parties are liable for the dividing up of their assets and the paying off of their debts.
Having an ANC in place prior to marriage is the only way to avoid the law of community of property, and it gives couples the freedom to decide how their assets and debts should be divided in the event of a divorce. Couples can decide how their assets will be divided, and which party will be responsible for which debts. An ANC also provides couples with the option to opt-out of the law of community of property and to instead enter a marriage contract that is tailored to their specific needs and circumstances.
