THE LAW: NEW EPC REGULATIONS YOU NEED TO KNOW

The National Energy Act (Act 34 of 2008), together with the Regulations for the Mandatory Display and Submission of Energy Performance Certificates (EPCs), requires certain buildings to display a valid Energy Performance Certificate. These regulations are enforced by the Department of Mineral Resources and Energy (DMRE).

Effective December 2025
✔ Private-Sector Buildings (2,000 m² or Larger)

A valid Energy Performance Certificate (EPC) must be displayed at the main entrance of buildings used for:

Offices
Educational facilities
Public assembly or gathering venues
✔ Government Buildings (1,000 m² or Larger)

All qualifying government-owned buildings are also required to display a valid EPC.

✔ Penalties for Non-Compliance

Failure to comply with the regulations may result in:

A fine of up to R5 million
Imprisonment for up to 5 years
Or both, as provided for under the National Energy Act.

In South Africa, an Energy Performance Certificate (EPC) measures the energy efficiency of certain non-residential buildings and rates them from A (most efficient) to G (least efficient). EPCs are based on annual energy consumption per square metre and are issued according to the South African standard SANS 1544.

Step 1: Determine if your building requires an EPC

An EPC is generally mandatory if your building:

Is a private-sector, non-residential building larger than 2,000m²
Is a government building larger than 1,000m²
Has been operational for at least two years
Falls into occupancy categories such as offices, educational facilities, entertainment venues, or places of public assembly.

Step 2: Gather the required information

You will typically need:

12 months of electricity and energy consumption data
Building floor plans and net floor area measurements
Occupancy and vacancy information
Details of any excluded areas or mixed-use spaces.
Step 3: Appoint a Registered EPC Professional

The assessment must be conducted by a registered EPC professional or an accredited inspection body that can verify your building data and calculate its energy performance rating.

Step 4: Assessment and Certification

The EPC professional will:

Review your building information
Calculate energy consumption per square metre per year
Validate the data
Submit the information to the National Building Energy Performance Register
Issue the official Energy Performance Certificate.

Step 5: Display and Maintain the Certificate

The EPC must be:

Displayed prominently at the building's main entrance
Submitted to the national register
Renewed every five years.

In South Africa, any system operating in parallel with the municipal or Eskom grid must be authorised by the relevant electricity provider before commissioning.
