California Assembly Bill 956 (AB 956) was signed into law by Governor Gavin Newsom on September 29, 2026, and takes effect on January 1, 2027.
Key Provisions of AB 956
• Two Detached ADUs: Local agencies must ministerially approve up to two detached, new-construction accessory dwelling units (ADUs) on a single-family or qualifying residential lot, doubling the previous limit of one.
• Setbacks and Size Limits: The new detached ADUs are eligible for up to 4-foot side and rear setbacks. Local agencies may cap the floor area of each unit at 800 square feet.
• Zoning Clarifications: Revises restrictions from "lot zoned for single-family residential use" to "lot zoned to allow single-family residential use," expanding eligibility and streamlining development rules.
• HOA and Common Interest Restrictions: Amends the Civil Code to limit restrictions or prohibitions on ADUs and junior accessory dwelling units (JADUs) within applicable common interest developments and planned developments.
• Rental Terms: Sets permitted rental terms to over 30 days without requiring nonconforming zoning corrections or primary residence fire sprinklers under specific conditions.
