Key Insurance Rules for Falling Limbs
Peril-Dependent: Standard policies cover falling limbs if they are brought down by a sudden “covered peril” like wind, lightning, or the weight of ice and snow
The “Where It Lands” Rule: Insurance typically only pays out if the limb hits a covered structure (like your house, garage, or fence) or blocks primary access points like your driveway. If a limb simply falls safely into your grass without hitting anything, insurance will not pay for the debris removal.
The Negligence Clause: If a limb falls because the tree was dead, rotting, or visibly neglected, the insurer can completely deny the claim.
Trimming dead and fungus filled limbs limbs is standard practice and is part of routine maintenance for trees. Don’t neglect your trees and have dead limbs removed immediately, and a major trimming of the crown every 2 to 3 years.
