🏠 NEW HAMPSHIRE HOMEOWNERS: YOUR BACKYARD MAY HAVE MORE POTENTIAL THAN YOU THINK.
New Hampshire has made major changes to the rules surrounding Accessory Dwelling Units, and if you own a single-family property, it’s worth understanding what those changes could mean for you.
Under New Hampshire’s expanded ADU law, municipalities with zoning must allow one ADU as a matter of right in districts that permit single-family homes, and that ADU can be attached or detached. The law also limits how restrictive municipalities can be on ADU size and allows conversions of existing structures such as detached garages under specified circumstances.
And the law continued evolving in 2026.
Effective August 31, 2026, HB 1079 further addressed ADUs involving certain existing structures, including structures that may not meet today’s setback or lot-coverage requirements.
That could open new conversations around:
🏡 Backyard cottages
🚗 Garage conversions
👨👩👧 Multigenerational living
👵 Aging in place
💰 Rental housing
🏠 Creating another home on property you already own
But “by right” does not mean “build anything, anywhere.” Building codes, septic and wastewater capacity, dimensional requirements, permitting and other state and local regulations can still matter.
That’s exactly why The ADU Exchange exists.
Before you start calling contractors or drawing plans, understand the property, understand the rules and understand the process.
