Water has always been one of Texas' most valuable resources, and beginning July 1, 2026, sellers may see a new TREC form related to groundwater and surface water rights. The new Water Notice disclosure was created to provide buyers with additional information about water rights associated with a property, including whether certain groundwater or surface water rights may convey and whether water wells are present.

For buyers looking at acreage, ranches, recreational properties, or rural homes, water rights and water sources can be an important part of the due diligence process.

This doesn't mean every property suddenly comes with valuable water rights, but it does mean buyers and sellers will have more information available during a transaction.
