Construction bonds are a type of surety bond that protects the project owner (obligee) in case the contractor (principal) fails to meet their contractual obligations. There are three main types of construction bonds: bid bonds, performance bonds, and payment bonds.
A bid bond guarantees that the contractor will enter into a contract if they are awarded the bid. A performance bond guarantees that the contractor will complete the project according to the contract specifications. A payment bond guarantees that the contractor will pay all subcontractors and suppliers for their work and materials.
The surety company is the third party involved in a construction bond. They issue the bond to the contractor and pay claims to the obligee if the contractor defaults on their contract. The contractor is responsible for reimbursing the surety company for any claims they have to pay.
Construction bonds benefit both the obligee and the principal. The obligee is protected from financial loss if the contractor fails to meet their obligations. The principal benefits because construction bonds make them more attractive to potential clients.
