When DBE rules shifted in 2025, states did not respond uniformly.

At The Blueprint Conference 2025, Adrian D’Arcy, Founding Partner of D’Arcy Vicknair, and Murphy J. Foster, III of Breazeale, Sachse & Wilson, L.L.P., examined how agencies across the country were responding to the changing federal direction.

Some states temporarily suspended their DBE programs, while others continued moving forward as contractors, agencies, and legal teams waited for clearer guidance.

For companies working on public projects, that uneven response added another layer of uncertainty to bidding, compliance, and planning.

Sometimes the smallest contract details can have a big impact on how risk is ultimately allocated.

At The Blueprint Conference 2025, Robert Tschirn, Partner at Riess LeMieux, LLC, and Neal Choppin, Area Senior Vice President at Cadence Insurance, a Gallagher Company, examined how indemnification and additional insured coverage intersect under Louisiana’s Construction Anti-Indemnity Act.

Using a Louisiana Fourth Circuit case as an example, the conversation delved into insurance costs, contract language, and the requirements that can determine whether certain risk-transfer provisions are enforceable.

They also emphasized an important point for project teams: additional insured requirements and indemnity provisions should work together as one and the same, so the additional insured requirements do not exceed the indemnity provisions, and thereby perhaps run afoul of some interpretations of the Louisiana Anti-Indemnity Act.

Tight project financing can create pressure that extends well beyond the budget.

At The Blueprint Conference 2025, John Wolf, Consultant, shared an owner’s perspective on contingency planning and the consequences when project financing leaves too little room for the unexpected.

John explained that owner and contractor contingencies serve different purposes, and when those lines blur, the effects can ripple across the project. Value engineering, peer reviews, and even the designer’s role as a communication link between the owner and contractor can all come under pressure.

The bigger point: contingency planning is not simply about setting aside dollars. It can influence how effectively the entire project team responds when conditions change.
