NJ COASTAL RULE CHANGES – WHAT YOU NEED TO KNOW
We’ve been getting a lot of calls and questions about the recent changes affecting New Jersey’s coastal areas, so here’s a simple breakdown.
First, the good news:
NJDEP has officially proposed a one-year extension to the “legacy provisions” of the REAL (Resilient Environments and Landscapes) rules.
The deadline to qualify under the current flood elevation requirements has been extended from July 20, 2026 to July 20, 2027.
What does that mean?
It means you have one more year to get your plans and permit applications submitted under the current flood elevation standards.
Does that mean nothing else changes?
Not exactly.
Even with the extension, the permitting process has changed.
Any new home, house raise, or addition within New Jersey’s coastal areas now requires NJDEP Land Use approval before construction can begin.
This applies throughout the areas we serve, including Long Beach Island (LBI) and Beach Haven West.
What does this mean for your project?
Because of the new NJDEP permitting requirements, projects need to begin much earlier than they did in the past.
These approvals can add approximately 3–4 months to the overall planning and permitting process.
What happens after July 20, 2027?
Projects that do not qualify under the legacy provisions will be subject to the new REAL rules.
For many properties, the required design flood elevation increases by approximately 4 feet.
That could mean:
• A home addition may require raising the entire house.
• New homes may need to be built significantly higher.
• Ceiling heights, layouts, stair designs, and overall design flexibility could be affected.
• Construction costs may increase due to the additional elevation requirements.
