My name is LeRoy Puckett. I am seeking representation or consultation regarding a civil rights matter arising from July 1, 2019 by a King County Metro bus driver while he was on duty.
The incident involved a physical assault resulting in spinal injury (documented by medical providers) and was accompanied by explicit racial accusations made by the driver to justify his conduct. The event was captured on video and audio, and media declarations were provided during discovery confirming the injuries and review of recordings.
I filed suit within Washingtonβs three-year statute of limitations (RCW 4.16.080). The trial court granted summary judgment for defendant, which I objected to, and I have transcripts, on purely legal grounds, including misapplication of the statute of limitations and refusal to recognize relation back under FRCP 15(c). Those issues were preserved for appeal and are legal in nature (Dupree v. Younger).
I believe viable claims exist under 42 U.S.C. Β§ 1983, including excessive force and Equal Protection violations by a government employee acting under color of state law. No new facts are being introduced β the issues concern legal characterization and statutory interpretation.
