Owners may not realize that the Harris County Flood Control District (HCFCD) requires acknowledgement of United States Army Corps of Engineers (USACE) permitting for work done in HCFCD rights-of-way (ROW). HCFCD designs, implements and maintains flood infrastructure in Harris County. Businesses looking to expand their existing developments or looking to build new developments within Harris County are subject to HCFCD regulations. This can require:

A Wetlands Delineation to investigate potential Waters of the United States (WOTUS) or other regulated waters under USACE jurisdiction within the project area.

A Threatened & Endangered Species Review to determine the presence of protected species.

A Cultural Resources Review to assess impacts the project may have to historical sites.

When required, these studies must be accurate, as the business owner will be held liable for damages to WOTUS and/or historical sites that may occur during construction.

The U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (USACE) announced on August 4, 2021, that the agencies would begin revisions of the “Waters of the United States” (WOTUS) regulations. What this means for you:

Restoration of regulations defining “Waters of the United States” to pre-2015 standards.

Reinstitution of the 2015 Clean Water Rule and the discontinuation of the Navigable Waters Protection Rule.

Expansion of protected waters to include wetlands without a surface water connection; “adjacent lakes and ponds that are not jurisdictional as tributaries”; as well as non-adjacent, intrastate, non-navigable waters.

Increased regulations and permitting for entities looking to build on their property near bodies of water, and farmers and ranchers that use non-jurisdictional waters of the U.S. for irrigation.

Christmas Bird Count
December 15, 2018

Please don’t forget to sign up for Christmas Bird Count at [email protected]. This is not an Armand Bayou Nature Center event, but is done in partnership with Houston Audubon Society. The Audubon Society invites birders of all ages and skill levels to participate in this international event. Birders will rise with the sun and spend one day counting every bird they see. This is the largest avian census and not possible without volunteers just like you!

They also need lots of feeder watchers within the circle so if you can’t make all day and would still like to participate, please sign up to be a backyard feeder watcher/counter, at the same email address.
