📢 Texas Homeowners — Know Your Rights & Protect Your Property!
When it comes to storm damage repairs, insurance claims, and contractor work, understanding Texas law matters more than ever. Here are a few key things every homeowner should know before signing any agreements:
⚖️ Texas Law & Conflict of Interest:
Under Texas Insurance Code Sections 4101.251(b) and 4102.163, it is illegal for a contractor to act as or advertise as an insurance adjuster on a property where they are also doing the work — even if they hold an adjuster license. This law exists to protect you, the homeowner, from conflicts of interest and to ensure that only licensed public adjusters negotiate with your insurance carrier on your behalf.
🔧 Unlicensed Contractor Activity:
In Texas, general contractors and roofers aren’t licensed at the state level — but many cities require local registration. Trades like HVAC, plumbing, and electrical work ARE state-regulated, requiring licenses through TDLR or the Texas State Board of Plumbing Examiners. If a contractor is doing work without proper licensing or registration, they may face penalties — and so could your project.
🚨 Risks to You as a Homeowner:
Hiring an unregistered or unlicensed contractor can:
• Void your contract
• Leave you financially liable for mistakes or damages
• Make insurance claims more complicated or even denied
• Leave you exposed to liability for injuries or code violations
🛡️ Public Adjusters Must Stay Compliant Too:
A licensed public adjuster’s role is to advocate for you during the insurance process — not to refer or partner with unregistered contractors. If they knowingly engage with unqualified or unregistered contractors, they may be violating TDI regulations and could face disciplinary action.
✅ Always check credentials, verify city licensing, and make sure your contractor and your public adjuster are working in your best interest — not their own.
