Homeland Security is direct from the US President which involves Federal/National/International Law.
Due process for states is entirely different. Either is an arrest first, for civil or criminal depending on the information given law enforcement at hand. Where they are detained is done after the arrest depending on the situation of circumstance & location. You do not go before a judge for due process before you are arrested. Once you are brought up on charges, arrested or detained, then you are questioned and due process begins. Not all cases or jurisdiction is the same and FB is not where the judge or jury hold trial. They will get their due process to prove where they came from, how they got here & who they are. Nothing is being taken from them. It will be handled via national/international, one country to another, as they are not legal citizens, they are here illegally, unless they can prove otherwise.
So let's be honest here ... starting with local government, who is harboring them, paying for them, and is there a vetting system in place? Just stating capture & detain & due process doesn't change the FACTS of illegally entering the country. If the federal government is involved, why isn't local government doing the part of putting something in order with identification of criminals for the safety of US citizens? 🤔 Are they just importing slaves as undocumented workers for their own political agendas or will they work with US authorities to determine the violations of where these people came from, why they came here and what their past records of law, order & health concerns are before just putting them in glass houses with benefits. I mean, come on....seriously, you don't just end up on Nantucket Island without a plan by someone? If real news reporters wanted to get this done right we would have something accomplished other than POLITICAL AGENDAS.

Unless you know the actual process BEFORE and AFTER of each step taken, you have no real explanation of due process. To capture illegal criminals, you do not 'serve' them with a search warrant. Each case is different, just as each unit or area is different, depending on the circumstances given previously to an arrest. Tips are made just as a raid if it is known of illegal, allegedly or otherwise, and that does start due process between US and the international governments, as they are not here as legal citizens.
