Most homeowners don't know this ADU rule — but it could change everything.

Your basement counts toward your GFA calculation. Finished or unfinished. As long as the ceiling height is over 6'8" from concrete floor to floor joist.

The question on the BuildX Podcast: do you have to alert the town before condoing an ADU?

The answer: no. And here's the reasoning.

An ADU is permitted as an accessory use to the primary home — that's the zoning piece. But creating a condominium is about ownership. And zoning does not dictate ownership.

Those are two separate things governed by two separate processes. The ADU permit goes through the town. The condominium structure — if a homeowner chooses to pursue it — is handled entirely through attorneys, with no local approval required.

You get the permit. You build the ADU. The ownership question is handled separately, on its own timeline, through its own legal process. The town doesn't need to be part of that conversation.
