Ours is a similar story just a different location....

"With the delays and the additional expenses they’re imposing on us, it almost becomes an impossible task for us to do," the local business owner admits.

Dream turns to Nightmare

WE had the written approval of Cherokee County Planning and Zoning to operate from this location at 11397 Bells Ferry BEFORE we invested 227K and then they decided it did not fit with their land use plan and they told us they would not issue a business license. Dallas North has been in business 25 years and in Cherokee County for the last 15 years. We survived multi year floods, 2008 financial crisis and COVID but never would have expected our local government to create hardship. This continues to be unresolved and began in the busiest season of our year. We apologize to any customers who have not received our utmost attention as this has been a heavy burden. This is what can happen when local government has the power to deny or issue a business license for no other reason than an arrogant abuse of power and misinterpretation of THEIR OWN ordinance and building codes. Video to follow of the our new location that is 35 yards from a commercial unkempt property and a gas station commercial crossroad. We have full support of our neighbors and there is no public concern. In fact, our neighbors want our business here. We want to improve the character of the neighborhood and reface the house but we are prevented from spending money on improvements until we can stop this ridiculous government overreach. The Planning department is forcing us to spend thousands on the nonsensical and ambiguous interpretation of commercial codes that are applicable to Walmart and not our 1929 850square foot house. Example: Commercial code and fire code of occupancy load for entire house would only be 6 but county inspector wants a structural engineer to redesign our foundation to hold a capacity of 15 people in a 100 square foot area. WHAT? Would you spend thousands on an expensive planning attorney to defend this nonsense or would you spend the money on unnecessary renovations? Either way THOUSANDS of dollars create a hardship and government has the power to act with immunity.
Why does Cherokee County not want small business?

What happens when government creates financial hardship for small business and working families? This could happen to any small business or individual who does not have the resources to hire expensive land use and zoning attorneys to protect their rights. We complied with Cherokee County and asked permission every step of the way. In fact, the attached letter to the Commissioners requesting an appeal was sent after planning/zoning approved our land use by sending us an approval letter and giving us an encouraging phone call wishing us luck on the closing BEFORE we purchased the property. Imagine our shock when they just changed their minds regarding permissive use without even a phone call days after spending 227K from our savings.

Attached is my letter to the Commissioners requesting them to take on the appeal which is still not settled because the Planning/Zoning department that made the mistake is the department that the commissioners are sending us back to and not surprisingly this department may be a bit miffed that their error was exposed. Now Planning and Zoning has decided that we will need to spend THOUSANDS more money for ambiguous reasons on a 1929 850squareft house(NOT open to public and and NO employees will be working there )with no guarantee we will even be able to renew our license at this location or resell the home commercially. . Planning and Zoning lost the battle but now they want to win the war by forcing us into financial hardship before they will issue a business license. At every turn we receive a roadblock from planning/zoning that defies common sense AND the building code itself.

This is the danger of our local government and what they can do when they have the power to issue or deny a business license based on a whim, an offended ego, or just plain ignorance. I have a meeting with the GA Department of Economic Development as small business is the lifeblood of our economy and they are very interested in our story. Unfortunately, I believe only local exposure will help stop the ridiculous lack of common sense or perhaps make someone in power care a bit more about our business in jeopardy.
