Under the Landlord and Tenant Act 1985, residential landlords can have repairing obligations covering the structure and exterior of a property, as well as key installations for water, sanitation, heating and other essential services. Leaking roofs aren't just a maintenance problem. It could be a Section 11 issue.

But here’s where it gets interesting: finding the defect is only the beginning.

The burden should be: What caused it? How extensive is it? How long has it existed? What repairs have been attempted? And what evidence is available?

Persistent damp, water pe*******on, mold, poor drainage, or infestations can sometimes raise the question of statutory nuisance, but the presence of a defect alone does not automatically meet the legal test.
