Performing work on your home which involves a party wall without a party wall agreement is extremely risky, as it is legislative law. Legislation states you must inform your neighbour prior to any work being carried out, and with time for them to seek their own advice regarding any of the proposed work.

The reason being it gives your neighbour or the other property owner the right to object or make preparations they need to, Where there is a distinct disagreement regarding the works it allows both parties to come to an amicable agreement.

Proceeding with work without a party wall agreement or against clear objections can have serious consequences and leave you liable to provide the other party with compensation if a court settles in their favour.

It isn't uncommon for there being disputes to a party wall agreement, and often there is nothing that cannot be resolved so the agreement can be accepted by both parties.

It is highly beneficial for both parties to work together in finding this resolution rather than fighting it out so to speak. As a specialist party wall surveyor we can work for both parties, where it is acceptable to both. This allows us to help find a resolution much more quickly and in the process reduce the costs for both if they insist on appointing their own surveyor.

Where there is unreasonable objection to a party wall agreement we can help our client take all the necessary measures required to allow the work to be carried out with no or little risk of comebacks at a later date. Simply deciding to go ahead with work without doing this is highly risky, especially with the other party already stating their feelings against it.

A party wall agreement is designed to give the other party sufficient notice of any work being performed so that should they need to do so, they can make arrangements to compensate for any disruption the process may cause. Arun Associates are experienced Expert Witness Building Surveyors, not just with the knowledge of the subject matter in question but also with legal protocols. Including how to detail and present technical evidence to the court or tribunal. Therefore could be an asset to you in such instances.
