FINISHING TOUCH
PAINTING & DECORATING
CUSTOMER TERMS & CONDITIONS Inveraray, Argyll
These Terms & Conditions apply to painting and decorating services provided by Finishing Touch (βweβ, βusβ, βourβ) to
customers (βyouβ, βyourβ). They form part of the contract between Finishing Touch and the customer and should be read
together with the individual quotation. Nothing in these Terms & Conditions affects any statutory rights you have as a
consumer.
1. Quotations
Our work is normally provided on a fixed-price quotation basis.
The quotation will describe, as clearly as reasonably practicable, the areas of work, preparation, finishes and materials
included in the agreed price.
Unless otherwise stated, quotations are valid for 30 days from the date issued.
Our quotation is based on the condition of the property and surfaces that can reasonably be assessed when the quotation is
prepared.
Where a quotation is prepared without an inspection, for example from photographs or information supplied by the customer,
the price may need to be reviewed if the actual condition differs materially from the information provided.
A quotation does not include work that is not specifically described or reasonably implied within the agreed scope.
2. Acceptance of a Quotation
You may accept a quotation by confirming acceptance by email, text message, in writing or another clear method.
Once accepted, the agreed quotation and these Terms & Conditions form the basis of the contract.
Changes to the agreed work should be agreed before additional work is carried out wherever reasonably practicable.
3. Deposits and Materials
Finishing Touch does not normally require a deposit.
Where the cost of materials for a particular project is expected to exceed Β£500, we may require an advance payment towards
materials.
Where an advance payment is required, the amount will be clearly stated on the quotation before the work is accepted.
Any advance payment will normally be used towards materials and other reasonable project costs and will be accounted for
in the final project price.
We will not normally purchase unusually expensive or specialist materials until any agreed advance payment has been
received.
4. Paint and Materials
Unless otherwise agreed, Finishing Touch will supply the paint and decorating materials required for the work.
We will select products reasonably suitable for the agreed application and finish.
Where a particular brand, product or specification has been agreed, we will use that product where reasonably available.
If a specified product becomes unavailable, we may recommend a suitable alternative and will discuss any material difference
in cost or specification before proceeding.
Where you specifically request a particular product or colour, you are responsible for confirming that the choice is suitable for
your requirements.
5. Colours and Finishes
You are responsible for confirming the colours and finishes required before work commences.
Colours can appear differently depending on lighting, surrounding colours, surface texture and the type of finish used.
Where a customer changes a colour after work has commenced, additional paint, preparation and labour may be charged. If you change your mind about a colour after it has been applied, repainting will normally be additional to the original
quotation.
6. Preparation
The quality of the finished decoration depends substantially on the condition of the underlying surface.
The quotation will state the level of preparation included wherever reasonably practicable.
Normal preparation may include appropriate cleaning, filling, sanding, scraping and minor surface preparation necessary for
the specified finish.
Additional preparation may be required where surfaces contain significant peeling or failing paint, cracks or damaged plaster,
holes, wallpaper or adhesive, ni****ne or other staining, grease or contamination, mould or mildew, water damage, damaged
or rotten timber, excessive previous coatings, or other defects that could not reasonably have been identified when the
quotation was prepared.
Where significant additional preparation is discovered, we will discuss the work and any additional cost before proceeding
wherever reasonably practicable.
If you choose not to have recommended preparation carried out, we cannot guarantee the final appearance or durability
where the underlying condition affects the result.
7. Damp, Mould and Underlying Problems
Decorating work does not normally resolve the underlying cause of damp, mould, condensation, leaks, structural movement
or other building defects.
Where we identify an apparent underlying problem, we may recommend that it is investigated and rectified before decorating
work continues.
We cannot guarantee the longevity or appearance of paintwork where an underlying problem remains.
We are not responsible for subsequent paint failure caused by an underlying building defect outside our control.
8. Additional Work and Variations
Our fixed price applies to the work specifically included in the quotation.
Work requested by the customer outside the original quotation will be treated as additional work.
Examples include additional rooms or areas, additional preparation, repairs, additional coats where not reasonably
foreseeable, wallpaper removal, extensive stripping, changes to colours, additional furniture or items, or work requested after
the quotation was accepted.
Where reasonably practicable, we will agree the additional cost before carrying out the work.
Additional work is not automatically included within the original fixed price.
9. Customer Preparation
Before work begins, you should, where reasonably practicable, remove ornaments and personal items from working areas,
remove pictures and wall-mounted items, move furniture away from walls, secure valuable or fragile items, make us aware of
particularly valuable or delicate items, and provide reasonable access to all areas included in the quotation.
Where furniture cannot reasonably be moved, we will protect it as far as reasonably practicable.
We reserve the right not to move exceptionally heavy, fragile, valuable or specialist items.
10. Protection of Your Property
We will take reasonable care to protect floors, furniture, fixtures and fittings from paint and decorating materials.
Appropriate dust sheets, protective coverings and other measures will be used where reasonably required.
You should tell us before work starts about any particularly valuable, fragile or vulnerable items.
We cannot accept responsibility for damage caused by pre-existing defects, deterioration, inadequate installation or
weakness in items being worked around.
11. Access and Working Conditions
You must provide safe and reasonable access to the areas included in the quotation. Where required, reasonable access to electricity, water and suitable working facilities should be available.
We may suspend or postpone work where working conditions are unsafe or unsuitable.
For exterior work, weather conditions may affect whether paint can be applied safely and achieve an appropriate finish.
Weather-related delays will be rearranged for the earliest reasonably practicable suitable date.
12. Start and Completion Dates
We will agree an anticipated start date with you.
Unless expressly stated otherwise, start and completion dates are estimates rather than guaranteed completion dates.
The duration of a project may be affected by unforeseen preparation, additional work, weather, drying times, material
availability or circumstances outside our reasonable control.
We will make reasonable efforts to keep you informed of significant delays.
13. Payment
Unless otherwise stated on the quotation, the balance is payable on completion of the agreed work.
Where staged payments have been agreed, the payment schedule will be stated on the quotation.
Any advance payment for materials will be deducted from the final amount due.
We will provide an invoice for the amount due.
If an undisputed amount remains unpaid after it becomes due, we reserve the right to suspend further work or decline
additional work until the outstanding amount is resolved.
Nothing in these Terms & Conditions removes or limits any statutory rights you may have regarding defective or incomplete
work.
14. Inspection and Completion
On completion, you will have a reasonable opportunity to inspect the work.
If you believe that any aspect of the work does not comply with the agreed quotation, please notify us as soon as reasonably
practicable.
We will investigate genuine concerns and, where appropriate, arrange reasonable remedial work.
Minor variations in texture, brush or roller finish may occur depending on the substrate, lighting, product and finish selected
and will not necessarily constitute a defect.
15. Snagging and Defects
If you identify a potential defect after completion, please contact us promptly and provide details of the issue.
We will be given a reasonable opportunity to inspect the work and, where appropriate, rectify the issue.
Customers should not normally appoint another contractor to carry out remedial work before giving Finishing Touch a
reasonable opportunity to inspect and address the issue.
This does not prevent you from taking reasonable steps where immediate action is necessary to prevent further damage.
Where a problem is caused by an underlying defect, customer-supplied materials, subsequent damage or circumstances
outside our control, remedial work may be chargeable.
16. Cancellation by the Customer
If you need to cancel or postpone a project, please notify us as soon as possible.
Where applicable law provides a statutory cancellation right, those rights will apply.
Where a customer cancels outside any applicable statutory cancellation period, we may seek recovery of reasonable losses
actually incurred as a result of the cancellation, where legally permitted.
This may include reasonable non-refundable costs for specially purchased materials or other costs genuinely incurred
specifically for the project.
Any cancellation charge will reflect our reasonable actual loss and will not operate as a penalty.
17. Cancellation by Finishing Touch We reserve the right to postpone or cancel work where circumstances make it unsafe, impractical or impossible to carry out.
Where we cancel without lawful justification, you will retain any rights available to you under applicable law.
18. Pets and Children
For safety reasons, children and pets must be kept away from areas where decorating work is being carried out.
Paint, tools, ladders, equipment and other materials may present hazards.
We cannot accept responsibility for injury or damage resulting from customers, children or pets entering restricted working
areas contrary to reasonable instructions.
19. Photographs and Marketing
We may ask for permission to photograph completed work for our portfolio, website, social media and other marketing
purposes.
We will not knowingly publish your personal details alongside photographs without appropriate permission.
If you do not wish photographs of your property or completed work to be used for marketing purposes, please tell us.
20. Liability
Finishing Touch will carry out the agreed services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful.
We are not responsible for damage or failure caused by circumstances outside our reasonable control, pre-existing defects,
structural problems, damp, leaks, defective substrates or other conditions that were not reasonably apparent when the
quotation was prepared.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any
other liability that cannot legally be excluded.
21. Complaints
We aim to resolve any concerns quickly and fairly.
If you have a complaint, please contact Finishing Touch as soon as possible and explain the issue.
We will investigate the matter and, where appropriate, offer a reasonable remedy.
Where appropriate, we will arrange an inspection of the work before deciding what remedial action is required.
22. Consumer Rights
Nothing in these Terms & Conditions affects your statutory consumer rights.
Where applicable, services must be carried out with reasonable care and skill and in accordance with applicable consumer
legislation.
23. Governing Law
These Terms & Conditions are governed by the laws of Scotland.
Where necessary, disputes will be dealt with by the appropriate Scottish courts.
