The commitments followed coordinated action by the European Commission and national consumer protection authorities. They show that environmental promises were already being challenged under existing consumer protection rules.

⠀
Over the past 20 days, we have shared facts about consumer expectations, gaps in evidence and the consequences of misleading claims. Across different products and sectors, one question keeps coming back: can you prove what you promise?
⠀
If you still have questions about your environmental claims, our free EmpCo Green Claim Check is a practical place to start. Up to five claims, reviewed by a human, with results within two to three working days:

⠀
The figure measures public concern, not a scientifically confirmed level of health risk. But it shows how relevant the subject has become for consumers.
⠀
Claims relating to microplastics therefore carry considerable responsibility. Consumers need to understand exactly what has been assessed, which criteria were applied and what evidence supports the result.

⠀
Concern is not the same as scientific proof. But it shapes what consumers expect from products, packaging and the claims made about them.
⠀
When a claim responds to a concern this widespread, vague reassurance is unlikely to be enough. The wording needs to be clear, and the evidence behind it needs to be even clearer.

⠀
These are statutory maximums, not automatic penalties. The relevant turnover base, thresholds and calculation methods differ between countries.
⠀
EmpCo introduces common rules for environmental claims across the EU, while enforcement and sanctions remain rooted in national law.
⠀
As companies prepare their 2027 budgets, this exposure should be considered across every market in which a claim appears. Planning resources for evidence, reviews and independent verification is far more predictable than leaving a potential percentage of annual turnover at risk.

⠀
The rule has been in force since May 2024. Other methods of calculating the penalty may also apply, depending on the case.
⠀
This creates a direct connection between the reach of a campaign and its potential financial exposure: The more money placed behind a misleading claim, the greater the possible consequence.
⠀
As companies prepare their 2027 budgets, evidence and independent verification should be included in campaign planning from the start. A media budget for an environmental claim should also include a budget for proving it.

Environmental claims could already carry a high price before EmpCo.
⠀
Recent enforcement cases involving sustainability claims resulted in significant financial penalties:
⠀
€𝟴 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 for “Climate Protect”
⠀
€𝟭 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 for “designing a circular system”
⠀
€𝟮𝟱 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 in a case involving “sustainability is part of our DNA”
⠀
The cases arose under different laws and their amounts are not directly comparable. But together, they demonstrate that an unproven environmental claim can create a very real financial risk.
⠀
As companies prepare their 2027 budgets, claim substantiation should be planned alongside campaign spend. That means allocating resources for evidence, claim reviews and, where suitable, independent certification before publication.

Consumers are asking for concrete information. A precise percentage gives them something they can understand and gives companies a claim that can be measured and substantiated.
⠀
The clearer the environmental statement, the easier it becomes to explain what it actually means and what evidence supports it.
