Many property owners don't realise they have an adverse possession issue until they're planning to build, replace a fence, subdivide their land, or sell their property. A common sign is when an existing fence, garden, driveway, or other improvement has occupied land beyond the legal title boundary for many years. In Victoria, an adverse possession claim may be possible where land has been occupied continuously and exclusively for at least 15 years and the legal requirements are met.

Other indicators include discovering that the existing occupation differs from your title survey, finding historical boundary discrepancies, or learning that a neighbour has been using part of your land or you have been using theirs for an extended period. These situations are more common in older established areas where fences and occupation don't always align with the legal title.

If you suspect there may be a boundary issue, the first step is to engage us. A detailed investigation of historical survey records, the legal title, and the existing occupation can determine whether an adverse possession claim may be available or whether another solution is more appropriate.
