From our top 10 questions: What's a secondary residence?
Within the ACT, a Secondary Residence is a self-contained dwelling located on the same block as a primary residence, designed to be subordinate in design and function.
Whether you can build one depends largely on the circumstances of your block. Under the Territory Plan (Single Dwelling Housing Development Code) the minimum requirements are that it is:
- In a residential zone (RZ1, RZ2)
- In a block over 500 m2
- The secondary residence must have a size between 40 m2 and 90 m2.
Meaning that if your block has particularly high site coverage, large setbacks, or easements that prevent building in the rear zone, there may be issues in building a dwelling large enough.

From our website's top 10 questions: What's the difference between a Secondary Residence and a Detached Extension?

In the ACT, if your block is under 500 m2 in size, the option to build a Secondary Residence is not possible. However, you may be able to achieve a similar outcome through building a Detached Extension, or an Attached Extension onto your current dwelling.

The primary difference between a Detached Extension and a Secondary Residence is a Secondary Residence has all the components of a dwelling (kitchen, laundry, bathroom) whilst an extension – Detached or Attached - may not have all of those elements.
