New Swimming Pool Safety Legislation in the ACT
Starting May 1, 2024, the ACT Government requires all swimming pool and spa fences to meet current safety standards, regardless of their original construction date. This change aims to curb the rise in serious injuries and deaths related to pools in the ACT.
Homeowners have until May 1, 2028, to complete any necessary updates. Key requirements include:
1. Barrier Height and Non-Climbable Zone: The fence must be at least 1.2 meters high and have a non-climbable zone of at least 90 cm to prevent children from climbing over.
2. Gate Specifications: Gates must be self-closing from any open position and self-latching, with the latch mechanism located in such a position to meet Australian Standards.
3. Barrier Maintenance: Homeowners are required to ensure that pool barriers are maintained in good condition, with all doors and gates providing access to the pool kept securely closed when not in use.
4. Disclosure Requirements: Homeowners must disclose the pool's compliance status when the property is sold or leased.
5. Applicability: The new rules apply to all home swimming pools and spas that can contain water to a depth greater than 30cm
